DMCA Policy

John Lewis respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to valid notifications of alleged copyright infringement that are provided to our designated Copyright Agent.

This policy outlines the information required to submit a valid DMCA Notice or Counter-Notification to John Lewis.

Filing a DMCA Notice of Infringing Material

If you believe that material available on our site infringes on your copyright, please send a written notification to our Copyright Agent with the following information. Please be aware that you may be held liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is infringing your copyrights.

  1. Identification of the copyrighted work: A description of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit John Lewis to locate the material (e.g., URL on a John Lewis website, product name, etc.).
  3. Contact Information: Your name, address, telephone number, and email address.
  4. Good Faith Belief Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy and Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Physical or Electronic Signature: Your physical or electronic signature.

Upon receipt of a valid DMCA Notice, John Lewis will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the site.

Filing a DMCA Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may send a written counter-notification to our Copyright Agent. Please be aware that you may be held liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is not infringing the copyrights of others.

  • Identification of removed material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • Perjury Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Contact Information: Your name, address, telephone number, and email address.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which John Lewis may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Physical or Electronic Signature: Your physical or electronic signature.

Upon receipt of a valid Counter-Notification, John Lewis may restore the removed material, in its sole discretion.
